Terms and Conditions

1. Introduction

These Terms and Conditions ("Agreement") govern the use of services provided by IncreMedia Ltd ("IncreMedia", "we", "us", or "our"). By subscribing to or using our services, you ("Client", "you", or "your") agree to comply with and be bound by this Agreement. If you do not agree to these Terms, you must not use our services.

IncreMedia provides various digital solutions including, but not limited to:

3. Subscription & Payment

3.1. The basic subscription fee is £20.00 per month, which is required to create an account within the IncreMedia system. This base subscription price may increase at the discretion of IncreMedia. If a client chooses to have additional services then the monthly subscription will increase as per the chosen services at the price discretion of IncreMedia. Any further one-off payments for one-off work will be charged to the customer's payment method on file along with the monthly subscription.
3.2. This subscription fee is non-refundable and is charged monthly from the date of account creation.
3.3. The Client authorises IncreMedia to automatically withdraw the subscription fee and any future add-ons from the designated payment method on the billing date.
3.4. IncreMedia reserves the right to update subscription fees and pricing structures. Clients will be notified at least 30 days in advance of any pricing changes.
3.5. Failure to make payments may result in account suspension or termination.

4. Client Responsibilities

4.1. The Client is responsible for ensuring that all content, data, and materials uploaded to the IncreMedia platform comply with applicable laws and regulations.
4.2. The Client agrees that IncreMedia is not responsible for the security, integrity, accuracy, or availability of the Client's data.
4.3. The Client acknowledges that they must maintain secure credentials and prevent unauthorised access to their account.

5. Data Privacy & Communication

5.1. The Client consents to IncreMedia storing and processing their contact details (email and phone number) for the purpose of providing updates, promotional offers, and relevant service information.
5.2. IncreMedia has the ability to sell or share personal client data with third parties for marketing purposes and for in house actions of IncreMedia too.
5.3. IncreMedia implements security measures to protect stored data but is not liable for any data breaches, loss, or corruption.
5.4. IncreMedia has full access to the clients account and may access this on any chosen day and time from the time of account creation.
5.5. IncreMedia does not accept any loss of data, breaches, hacks or other related breaches of data or privacy. The client accepts and agrees to understanding this as part of the terms and conditions.

6. Account Termination

6.1. Clients may cancel their subscription at any time, but payments already made are non-refundable.
6.2. IncreMedia reserves the right to terminate any account due to:

6.3. Upon termination, IncreMedia may delete all stored Client data and shall not be liable for any resulting losses.

7. Limitation of Liability

7.1. IncreMedia is not liable for any loss of revenue, data, business opportunities, or other damages arising from the use or inability to use its services.
7.2. IncreMedia does not guarantee uninterrupted service and shall not be held liable for downtime due to maintenance, cyber threats, or unforeseen circumstances.

8. Intellectual Property

8.1. IncreMedia retains ownership of all proprietary technology, software, and intellectual property used in delivering its services.
8.2. Clients may not duplicate, modify, or distribute IncreMedia's intellectual property without prior written consent and approval from IncreMedia

9. Indemnification

9.1. The Client agrees to indemnify and hold harmless IncreMedia from any claims, damages, or losses resulting from misuse of services, non-compliance with laws, or breach of these Terms.
9.2 The client agrees that they have no rights or power to bring any legal action towards IncreMedia based on the services they provide, what's included in these terms and conditions and the agreement made upon creation of their account.

10. Dispute Resolution

10.1. In the event of a dispute between the Client and IncreMedia, both parties agree to attempt to resolve the dispute through good faith negotiations.

11. Refund and Cancellation Policy

11.1. No refunds will be issued for partial months of service, unused services, or account terminations initiated by the Client before the end of the billing cycle.

12. Service Level Agreement (SLA)

12.1. IncreMedia does not guarantee uninterrupted or error-free service. Scheduled maintenance and unforeseen system failures may cause downtime, and IncreMedia is not liable for any losses resulting from such disruptions.

13. Third-Party Integrations and Liabilities

13.1. Certain features of IncreMedia services may rely on third-party integrations. IncreMedia is not responsible for service interruptions, data loss, or security breaches caused by these third-party providers. These are all listed within the app marketplace, dashboard and settings of the clients IncreMedia account. These third party providers may change in the future and the client acknowledges that this may happen and agrees to understanding of section 13 and 13.1 of the terms and conditions for any future third party providers.

14. Fair Usage Policy

14.1. Clients must use IncreMedia's marketing, email, and automation tools within reasonable limits. Excessive usage that negatively impacts system performance may result in additional fees or account suspension.

15. Force Majeure

15.1. IncreMedia shall not be liable for any delay or failure to perform its obligations due to unforeseen events beyond its reasonable control, including but not limited to natural disasters, strikes, cyberattacks, or regulatory changes.

16. Compliance with Laws

16.1. IncreMedia does not accept responsibility for the following but not subject to: any data, information or related specific client information on their account. It's in IncreMedia's best interest to protect client data however IncreMedia does not accept any responsibility for anything in relation to data, privacy or protection for the clients. Clients must ensure they collect and use data in compliance with legal requirements and this is the clients sole ownership and responsibility when accepting these terms and conditions.

17. Amendments

17.1. IncreMedia reserves the right to modify these Terms and Conditions at any time. Clients will be notified of material changes via email or in-system notifications.
17.2. Continued use of the services after amendments constitute acceptance of the revised Terms.

18. Governing Law

18.1. These Terms shall be governed and interpreted in accordance with the laws of the United Kingdom. Any disputes arising shall be settled in the courts of United Kingdom
